ACKNOWLEDGMENT AND ACCEPTANCE OF RISKS AND LIABILITY RELEASE
Ticket purchases are NON-REFUNDABLE. You may choose to give, trade or sell your tickets to a 3rd party.
In consideration for being allowed to participate as part of the The Lights Festival presented by Viive Events LLC, a Utah limited liability company, and Viive Events LLC, a Utah limited liability company on the date of the event.
I, as the "Participant" ["the Undersigned" means the Participant when the Participant is age 18 or older AND both the Participant and the Participant's parent or legal guardian when the Participant is under the age of 18] understand, agree to, and accept the following:
WARNING: All forms of sky lantern releasing and related activities can be hazardous, including without limitation (1) slipping and falling on surfaces made wet or slippery by rain, (2) eye injury if goggles or other eye protection are not worn, (3) serious burns to you or others, and (4) damage to your personal belonging. You must be aware of your surroundings and you participate at your own risk. No lantern is to be brought from home; only lanterns provided by Event staff may be used. You must comply with instructions and commands from Event security and staff at all times. You must not release your sky lantern before being instructed by the event staff. Your safety depends on exercising your own judgment about your own safety.
Be alert to the many risks, including, but not limited to, flaming sky lanterns floating through the air from all directions, wet or slippery surface conditions, and collisions with other participants, spectators, and man-made and natural objects. Also be aware that your clothes and other personal items may become damaged by sparks or flame, which can ruin or otherwise harm them.
In consideration of allowing the Participant to participate in the Event, the Undersigned hereby agrees to ASSUME ALL RISKS associated with the Participant's participation in the Event. The Undersigned agrees to HOLD HARMLESS, RELEASE, DEFEND, AND INDEMNIFY The Lights Festival LLC, Viive Events LLC, the owner and operator of the Event venue, and their affiliated organizations and companies, insurance carriers, parents, agents, employees, representatives, assignees, officers, directors, and owners (each hereinafter a "Released Party") for ANY AND ALL LIABILITY and claims for injury or death to persons or damage to property arising from the Participant's participation in the Event, including those claims based on any Released Party's alleged or actual NEGLIGENCE or breach of any express or implied WARRANTY.
The Undersigned further agrees and understands that risks associated with the Event, in addition to those previously listed, include, but are not limited to: equipment malfunction, marked and unmarked obstacles, strenuous activity, and the actions of others directly or not directly involved in the Event. Participant understands and acknowledges he/she has been informed and understands all Event rules and regulations. Participant assumes the risks of engaging in Event activities. Participant recognizes and understands that being struck by thrown paint and collisions with other participants occur and injuries may be a common and ordinary occurrence at the Event.
I understand that I may take the opportunity to inspect the venue before the Event.
In consideration for allowing the Participant to participate in the Event, the Undersigned agrees that ANY AND ALL CLAIMS for injury and/or death arising from the Participant's participation in the Event shall be GOVERNED BY UTAH LAW and EXCLUSIVE JURISDICTION of any claim shall be in the State or Federal COURTS LOCATED IN SALT LAKE COUNTY, STATE OF UTAH. Recognizing the risk and dangers, the Undersigned understands the nature of Event activities and voluntarily chooses for Participant to participate in and expressly assume all risks and dangers of the Event, whether or not described above, known or unknown, inherent or otherwise.
In the case of a minor Participant, the undersigned parent or legal guardian acknowledges that he/she is also signing this agreement on behalf of the minor Participant and that the minor Participant shall be bound by all the terms of this agreement. Additionally, by signing this agreement as the parent or legal guardian of a minor Participant, the parent or legal guardian understands that he/she is waiving certain rights on behalf of the minor that the minor otherwise may have. The undersigned parent or legal guardian agrees that, but for the foregoing, the minor would not be permitted to participate in the Event. The Undersigned parent or legal guardian also agrees that if the Participant is injured, the parent or legal guardian authorizes medical care for the Participant and/or transport of the Participant to a medical facility at the parent/legal guardian's expense. Nevertheless, no provision in this agreement shall create a duty to provide medical care or transportation to any Participant. The furnishing of medical care is neither an admission nor an assumption of liability by the Released Parties.
By accepting this agreement without a parent or guardian's signature, the Participant represents that he/she is at least 18 years of age, or if accepting as the parent or guardian of a Participant, represents that he/she is the parent or legalguardian of the minor Participant.
If Participant is a minor: As a parent/guardian of the minor Participant, I have the authority to sign this agreement and hereby indemnify the Released Parties for awards, legal expenses, including reasonable attorney's fees and settlements arising out of any claims from the Participant's participation in the Event.

Purchase Policy
Our goal at Viive Events, LLC is to make your day of fun as easy and efficient as possible. Our Purchase Policy is designed to provide you with the information you need to ensure a smooth transaction and trouble-free retrieval of your tickets once you get to the venue. Please take a minute to read the following:
NO REFUNDS OR EXCHANGES
In accordance with our Terms of Service, Viive Events, LLC does not offer refunds or exchanges of tickets purchased for our anticipated event, on our selected registration platform, on the thelightsfest.com web site or via our mobile site. In addition, tickets purchased through Viive Events, LLC may be subject to a per-ticket Convenience Charge, which is non-refundable except in extraordinary circumstances where a theater was unable to honor your tickets purchased through Viive Events, LLC (i.e., if a show time is cancelled, no seat was available in the theater, etc.). Before purchasing your tickets we urge you to confirm the title, time and location of the shows, performances, appearances, events, special events, classes, or other similar artistic showcases ("Event" or "Events") you wish to see.
At the time of your order, Viive Events, LLC will place an order for your tickets in the Events' venue's ticketing system, reducing the number of seats available for the chosen event. While this allows us to provide our customers with the clear benefit of guaranteed seats, it prevents Viive Events, LLC and our venue theater partners from reselling tickets in the event that you do not attend your Event. However, your seat will only be guaranteed for up until twenty (20) minutes after the commencement of the Event.
Any refund or exchange is at the discretion of venue's management, in which event you should contact Viive Events, LLC's customer service if you also wish to request a refund of our Convenience Charge in the extraordinary circumstances described above (otherwise, the Convenience Charge is non-refundable, as stated above).
PICKING UP YOUR TICKETS
Please read your online and email confirmation pages carefully, as they provide you with important information about retrieving your tickets that may be unique to your chosen venue. Please remember to bring your Print-at-Home Referenced-Coded Ticket to the venue if you used this feature on Viive Events, LLC. If you can't print or don't have a printer, just take your confirmation number with you. Once you purchase a ticket on Viive Events, LLC's website, the venue holding the Event will be notified of your name and reference number and will allow you access to the Event upon confirmation of your name and reference number. Please be prepared to present your picture I.D. Many venues require all patrons to be over the age of twenty-one (21) to enter.
PAYMENT METHODS
Viive Events, LLC accepts American Express, MasterCard, and Visa. We also accept debit cards. Viive Events, LLC does not accept "Single-Use" card number security products.
TICKET CONFIRMATION AND EVENT RATING & REVIEW E-MAILS
As an integral part of your ticketing transaction with Viive Events, LLC, we send you via e-mail a ticket confirmation following purchase explaining how to retrieve your tickets at the venue, as well as a subsequent invitation to rate-and-review the Event. Providing feedback via the rate-and-review e-mail is optional; if you do not wish to participate, just ignore or delete that email.

If your event is cancelled, we will refund the amount you paid for your tickets (minus order processing, service and delivery fees) using the same payment method used for purchase. If your event is postponed, we will contact you with the new date and time. All Event personnel have the right to refuse entry to any ticket holder for any reason at their discretion. Venue and Talent are subject to change without notice and are not grounds for a refund. Anything promised by the promoter that is unfulfilled is not guaranteed by the seller and is not grounds for a refund.
